Introduction

Information on how to qualify to receive one (1) of four (4) gift cards up to the value of $200 form part of these Terms and Conditions. Participation in this promotion is deemed acceptance of these Terms and Conditions.

1. The Promoter is Now Finance Group Pty Ltd ACN 158 703 612 Australian Credit Licence number 425142 (“the Promoter”).
2. The promotion commences at 12:00am AEDT on 29 Dec 2023 and closes at 11.59pm AEDT on 1 March 2024 (“Promotional Period”).

Eligibility

3. Individuals must be Australian residents aged 18 years and over who take out a new NOW Finance personal loan that is lodged and settled during the Promotional Period (“Eligible Customers”).
4. Limits on the gift card:
   • only one (1) gift card will be offered per eligible loan settled.
   • if two or more people settle the same eligible loan, the gift card will be directed to Applicant One in the loan application.

Exclusions

5. This promotion excludes variations of an existing NOW Finance personal loan product, including the refinancing of an existing NOW Finance personal loan. Refinancing from another company is fine.
6. This promotion also excludes new customers who use a broker to source and assist in the settlement of the NOW Finance personal loan.
7. Employees (and their immediate families) of the Promoter, brokers and agencies associated with this promotion are ineligible to enter. Immediate family means any of the following: spouse, ex-spouse, de-facto spouse, child or step-child (whether natural or by adoption), parent, step-parent, grandparent, step-grandparent, uncle, aunt, niece, nephew, brother, sister, step-brother, step-sister or first cousin.

Gift Card

8. The value of the gift card will depend on the loan amount the Eligible Customer settles:
   • loan amounts between $5,000 and $10,000 will receive a $50 gift card,
   • loan amounts between $10,001 and $30,000 will receive a $100 gift card,
   • loan amounts of $30,001 or over will receive a $200 gift card.
9. Eligible Customers will be asked to select one (1) of the following four (4) retailers for their gift card:
   • Bunnings
   • Supercheap Auto
   • Red Balloon
   • Webjet
10. Eligible Customers who settle a NOW Finance personal loan through Finder will be able to choose any one (1) retailer from the options available at Prezzee.com.au/store/
11. The gift card must be used in conjunction with their own terms and conditions and within their expiry date.
12. Gift cards, including any unused portions, are not transferable or exchangeable and cannot be converted to cash.

How to claim

13. Eligible Customers will receive an email within 4 days after settlement seeking the selection referred to in paragraph 9 above.
14. Eligible Customers will need to make their selection within 14 days of the date of the email.
15. Once the preferred retailer is selected, no changes can be accepted.
16. The Eligible Customers will then receive the gift card from Prezzee, on behalf of NOW Finance, to the email address entered by ‘Applicant One’ in the loan application within 30 days of making the selection.
17. If no gift card is received, Eligible Customers should contact NOW Finance at marketing@nowfinance.com.au.
18. It is the customer’s responsibility to ensure the email address supplied and entered is correct. NOW Finance is not liable to replace the gift card if the email address is incorrect.

General

19. The Promoter reserves the right, at any time, to verify the validity of any Eligible Customer to receive the gift card in its sole discretion, to disqualify any individual who the Promoter has reason to believe has breached any of these Terms and Conditions, tampered with the claim process or engaged in any unlawful or other improper misconduct calculated to jeopardise fair and proper conduct of the promotion. Errors and omissions may be accepted at the Promoter’s discretion. Failure by the Promoter to enforce any of its rights at any stage does not constitute a waiver of those rights. The Promoter’s legal rights to recover damages or other compensation from such an offender are reserved.
20. If this promotion is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond the reasonable control of the Promoter, including but not limited to technical difficulties, unauthorised intervention or fraud, the Promoter reserves the right, in its sole discretion, to the fullest extent permitted by law:
    • to disqualify any individual; or
    • to modify, suspend, terminate or cancel the promotion, as appropriate.
21. The Promoter (including its respective officers, employees and agents) is not responsible for and excludes all liability (including negligence), for any personal injury; or any loss or damage (including loss of opportunity); whether direct, indirect, special or consequential, arising in any way out of:
    • any technical difficulties or equipment malfunction (whether or not under the Promoter’s control);
    • any theft, unauthorised access or third party interference;
    • any claim that is late, lost, altered, damaged or misdirected (whether or not after their receipt by the Promoter) due to any reason beyond the reasonable control of the Promoter;
    • any tax liability incurred by an Eligible Customer; or
    • use of the gift card.

Privacy Statement and Marketing Consent

22. By participating in this promotion, the individual authorises the Promoter to collect, hold, use and disclose their personal information in the ways indicated here and in NOW Finance’s privacy policy, including providing such information to third parties involved in the promotion and any relevant authorities. Participating in this promotion is conditional on providing this information.
23. NOW Finance may, unless the individual tells us not to, use the information to communicate with them by mail or electronically by, for example, email, phone, SMS, hyperlink to provide them with direct marketing and commercial communications, offers to issue or sell financial, credit and other products, financial services and credit guides and other disclosure documents. The individual should direct any request to opt out of receiving marketing material, not receive telemarketing calls, access and update or correct their personal information to NOW Finance by calling 1300 275 669.
24. The collection and disclosure of personal information provided in connection with this promotion will be handled in accordance with the Promoter’s Privacy statement (https://nowfinance.com.au/legal-and-policies/) which adheres to the Privacy Act 1988 (Cth) and Australian Privacy Principles.
