Introduction

By accessing or participating in NOW Perks, you agree to be bound by these Terms and Conditions.

NOW Finance Group Pty Ltd ACN 158 703 612, Australian Credit Licence No. 425142 (“NOW Finance”, “we”, “us” or “our”) operates NOW Perks.

NOW Perks gives eligible NOW Finance customers access to selected offers, rewards, cashback, discounts or benefits from participating partners. The participating partners are:

Econnex Comparison, a business name of CIMET Sales Pty Ltd ABN 72 620 395 726 (CIMET), Australian Credit Licence 546701; and
LendUs Pty Ltd (ACN 663 090 686), an Authorised Corporate Credit Representative (Credit Representative 566269) of Australian Credit Licence 486112.

These Terms and Conditions apply to the overall NOW Perks program.

Each partner’s offer is subject to separate terms and conditions issued by that partner.

If there is any inconsistency between these Terms and Conditions and the terms for a specific partner offer, the partner offer terms will apply to the extent of that inconsistency.

Customers should read these Terms and Conditions and the relevant partner offer terms before taking up any offer.

Eligibility

NOW Perks is open to individuals who:

(a) are who have an active NOW Finance loan at the time they start a NOW Perks partner journey, and where required by the particular offer, continue to have an active NOW Finance loan at the time they complete the relevant eligible transaction or switch;

(b) are aged 18 years or over;

(d) access the relevant offer through a NOW Perks link, page, email, SMS, app, customer portal, or other approved NOW Finance channel;

(e) meet the eligibility criteria for the relevant partner offer;

(f) provide accurate, complete and current information when using a partner offer; and

(g) are not otherwise excluded under these Terms and Conditions or the relevant partner terms.

NOW Finance or the relevant partner may verify a customer’s eligibility, including their identity, age, place of residence, NOW Finance customer status and participation in a partner offer.

Partner Offers

NOW Perks may include offers from third-party partners.

Partner offers may include cashback, discounts, referral benefits, access to selected services or other benefits.

Partner offers may have different eligibility requirements, exclusions, reward amounts, timeframes and support arrangements.

Access to a partner offer does not guarantee that a customer will be eligible for, approved for, or able to access the partner’s product, service, discount, cashback, reward or benefit.

Partner products and services are provided by the relevant partner, not NOW Finance, unless stated otherwise.

NOW Finance is not responsible for a partner’s products, services, advice, recommendations, application decisions, pricing, fees, charges, availability, customer service, fulfilment or ongoing service delivery, except to the extent required by law.

Customers should review the relevant partner’s product details, fees, charges, contract terms, privacy policy and terms and conditions before deciding whether to proceed.

NOW Finance does not provide financial, legal or tax advice in relation to any partner offer. Customers should consider whether a partner product or service is appropriate for their circumstances and obtain independent advice where appropriate.

Rewards, Cashback, Discounts and Benefits

Rewards, cashback, discounts and other benefits are subject to the terms of the relevant partner offer.

The amount, type, timing and method of any reward will be determined in accordance with the terms of the relevant partner offer.

A customer may need to complete certain actions before qualifying for a reward, including making an eligible application, entering into a contract, settling a transaction, completing a purchase, remaining connected to a service for a minimum period, or meeting other eligibility requirements.

NOW Finance may withhold, cancel or recover any reward, cashback, discount or benefit if it reasonably believes there has been an error, fraud, misuse, duplicate claim, tracking issue, breach of these Terms and Conditions, breach of the partner offer terms, or any other conduct that affects the fair and proper operation of NOW Finance Perks.

Tracking and Attribution

Customers may need to access a partner offer through an approved NOW Perks link, campaign code, referral code or other approved channel to qualify for a reward.

NOW Finance and its partners may use referral links, campaign codes, tracking codes, cookies or other tracking methods to verify whether a customer accessed an offer through NOW Perks.

Using a different device, browser, link, code, or channel may affect tracking and may make a customer ineligible for a reward.

NOW Finance may rely on information from partners to confirm whether a customer is eligible for a reward, cashback, discount or benefit.

Customer Support

Partner service enquiries must be directed to the relevant partner, unless the relevant partner’s offer terms state otherwise.

This includes questions about the partner’s product, service, application, quote, purchase, connection, fulfilment, pricing, fees, charges, contract terms or cancellation process.

NOW Finance may manage certain rewards, cashback or benefits, as set out in the relevant partner offer terms.

Missing Rewards, Cashback or Benefits

If you believe you are eligible for a reward, cashback or benefit but have not received it within the timeframe stated in the relevant partner offer terms, you should contact the party named in those partner offer terms.

A customer may need to provide information to support their claim, including:

(a) their full name;

(b) the email address and phone number used for the partner offer;

(d) the date they accessed or completed the offer;

(e) any partner reference numbers;

(f) proof of purchase, application, settlement, connection or completion, if relevant; and

(g) Any confirmation emails or messages from the partner.

A missing reward claim may be declined if NOW Finance or the relevant partner cannot verify that the customer met the offer requirements.

Offer Availability

NOW Perks and partner offers may not be available to all customers.

Offer availability may depend on factors including:

(a) NOW Finance customer status;

(b) customer location;

(d) product or service availability;

(e) partner approval criteria;

(f) referral tracking;

(g) campaign limits;

(h) offer start and end dates; and

(i) any other conditions set out in the relevant partner offer terms.

NOW Finance and its partners do not guarantee that any offer will remain available.

Changes to NOW Perks

NOW Perks is an ongoing program.

We may amend these Terms where reasonably necessary, including to reflect changes to the program, participating partners, legal requirements or our business operations.

Any changes will apply from the date they are published or otherwise communicated by NOW Finance, unless stated otherwise.

Commercial Relationships

NOW Finance may receive commissions, referral fees or other commercial benefits from participating partners where a customer takes up a partner product or service through NOW Perks. Any such commercial arrangement does not affect your rights under applicable law.

Privacy Statement and Marketing Consent

NOW Finance may collect, use and disclose personal information to operate NOW Perks, verify eligibility, track referrals, manage rewards, investigate missing reward claims, prevent fraud and administer partner offers.

NOW Finance may share limited personal information with participating partners where reasonably necessary to track referrals, verify eligibility, administer NOW Perks, investigate missing reward claims, prevent fraud or otherwise operate the program.

Partners may also collect, use and disclose personal information when customers access their products, services or offers. The relevant partner’s privacy policy will apply to how that partner handles personal information.

Customers should review the relevant partner’s privacy policy before continuing with a partner offer.

Customers may choose to receive marketing communications from NOW Finance. Marketing communications may be opted out of at any time by contacting NOW Finance on 1300 275 669 or marketing@nowfinance.com.au.

General Conditions

NOW Finance may work with participating partners to provide benefits and rewards under NOW Perks. However, nothing in NOW Perks creates a legal partnership, agency, joint venture, employment or other relationship between NOW Finance and any participating partner. Participating partners are independent third parties and are responsible for their own products, services and offers.

NOW Finance may, at its discretion, withhold, cancel or recover any reward, cashback, discount or benefit, or restrict or remove access to NOW Perks, if it reasonably believes that a customer has breached these Terms and Conditions, breached the relevant partner offer terms, provided false or misleading information, tampered with NOW Perks, or engaged in unlawful or improper conduct. NOW Finance may terminate your participation where we reasonably believe you have breached these Terms or engaged in fraud or misuse.

If NOW Perks or a partner offer is interfered with in any way or is not capable of being conducted as reasonably anticipated due to any reason beyond NOW Finance’s reasonable control, including technical difficulties, unauthorised intervention, fraud, partner issues or system failure, NOW Finance may, to the fullest extent permitted by law:

(a) disqualify any customer;

(b) withhold, cancel or recover any reward, cashback, discount or benefit; or

Failure by NOW Finance to enforce any of its rights at any stage does not constitute a waiver of those rights.

Liability

To the maximum extent permitted by law, NOW Finance is not responsible for products or services supplied by participating partners. Except where liability cannot be excluded by law, NOW Finance is not liable for any loss, damage, cost or expense arising from:

(a) the acts or omissions of a participating partner, including the partner’s products, services, advice, recommendations, application decisions, pricing, fees, charges, availability, customer service, fulfilment or ongoing service delivery;

(b) any technical difficulties, equipment malfunction, system failure or interruption affecting NOW Perks that is beyond NOW Finance’s reasonable control;

(d) any claim that is late, lost, altered, damaged or misdirected due to any reason beyond NOW Finance’s reasonable control;

(e) any variation in the value of a reward, cashback, discount or benefit;

(f) any tax liability incurred by a customer;

(g) any use of a reward, cashback, discount or benefit;

(h) a customer’s failure to meet offer eligibility requirements;

(i) incorrect, incomplete or outdated information provided by a customer;

(j) referral tracking issues caused by a customer’s device, browser, settings or use of an unapproved link; or

(k) a partner changing, withdrawing, rejecting, cancelling or failing to fulfil a product, service or offer.

Nothing in these Terms and Conditions excludes, restricts or modifies any rights or remedies you may have under the Australian Consumer Law or any other law that cannot lawfully be excluded, restricted or modified.

Interpretation

In these Terms and Conditions:

(a) Headings are for convenience only and do not affect interpretation;

(b) words in the singular include the plural and vice versa;

(d) a reference to a clause includes all subclauses of that clause; and

(e) “partner offer terms” means the separate terms and conditions that apply to a specific NOW Perks partner offer.

Governing Law

These Terms and Conditions are governed by the laws of Victoria, Australia. The parties submit to the non-exclusive jurisdiction of the courts of Victoria and any courts hearing appeals from those courts.

Nothing in these terms limits, excludes or modifies any rights you may have under the Australian Consumer Law or any other law that cannot be excluded.
